Ever since Donald Trump beat Hillary Clinton in last month’s election, liberals have been trying to figure out a way to ensure that he won’t actually be able to be president. Now, they’ve come one step closer to this goal as two electors have filed a lawsuit that may just stop Trump in his tracks.
Colorado electors Polly Baca and Robert Nemanich are trying to get their state to change the law that dictates they must vote for Trump since he won Colorado, as each of them wants to vote for Clinton. They will take their case to court on Monday, where it will be presided over by U.S. District Court Judge Wiley Daniel, a Bill Clinton appointee confirmed to the court in 1995.
“Plaintiffs are entitled to exercise their judgment and free will to vote for whomever they believe to be the most qualified and fit for the offices of President and Vice President, whether those candidates are Democrats, Republicans, or from a third party,” the plaintiffs argued in their brief, according to Politico.
The two electors argue that the law violates the way our founding fathers designed the Electoral College, claiming that Alexander Hamilton originally said it was meant to act as a check on the popular will, to ensure the election of a qualified candidate.
“It’s difficult to imagine a more impermissible law than one that requires someone to vote for a specific candidate. The concept is antithetical to the notion of democracy, free speech, and the Electoral College,” they wrote.
Baca and Nemanich hope that if their lawsuit is successful, it could lead to other laws being changed in 28 other states where electors are also fighting to vote for Clinton. Since this lawsuit will be heard by a Clinton appointee, it seems likely that they will be victorious…
